By using the Tripattendynt platform to offer services as an attendant (tour guide or personal travel assistant), you acknowledge that you have read, understood, and agreed to the following terms and conditions.
Tripattendynt reserves the right to update, modify, or change these terms at any time, without prior notice. Your continued use of the platform constitutes acceptance of any revised terms.
1. Responsibilities
As an attendant using the Tripattendynt platform, you agree to the following primary responsibilities:
Service Delivery: You are responsible for delivering the services you’ve committed to through the platform, whether it be acting as a tour guide, personal assistant, or providing transportation (if applicable). You must ensure that your services are of the highest quality, safe, and fulfill the needs of the travelers. This includes being well-prepared, knowledgeable, and engaging during the service.
Professional Conduct: Your interactions with travelers and other users of the Tripattendynt platform must always reflect professionalism. This means treating travelers respectfully, being punctual for bookings, and maintaining clear communication throughout the service. You are expected to demonstrate patience, respect, and a positive attitude at all times.
Compliance with Local Laws and Regulations: You are responsible for ensuring that you comply with all applicable local laws, regulations, and Tripattendynt policies related to your services. This includes maintaining appropriate certifications or licenses where applicable and following vehicle safety requirements when providing transportation.
Traveler Satisfaction: You should prioritize traveler satisfaction by ensuring that their needs are met, whether it’s providing a fun and educational experience, fulfilling requests, or handling any concerns that arise during the service. If a traveler has complaints or issues, you are expected to address them promptly and professionally.
Accuracy and Transparency: You must provide accurate, truthful, and up-to-date information on your profile and during communication with travelers. Misleading or false information about services, availability, or qualifications is prohibited.
Availability and Communication: You are responsible for maintaining an accurate availability schedule on the platform. If your plans change or you are unavailable, it is your duty to update your availability promptly to prevent inconvenience to travelers.
Confidentiality: You must respect the privacy of travelers and confidentiality of any personal information shared through the platform. This extends to not sharing travelers’ details or any private data with unauthorized third parties.
2. Valid Licensing and Fitness
If your services involve providing transportation as part of your role, you confirm the following:
Driver’s License: You must possess a valid driver’s license that allows you to legally operate a motor vehicle within the jurisdiction you are providing services. The driver’s license should be current, not expired, and compliant with local regulations.
Medical Fitness: You must be medically fit to operate a vehicle, meaning you are not impaired in any way by physical, mental, or medical conditions that would endanger your ability to drive safely. You must ensure that you are physically and mentally capable of providing services, including transporting travelers, without risk to their safety or well-being.
Necessary Approvals: You must obtain all required licenses, permits, and approvals necessary to legally operate your vehicle and provide services within your jurisdiction. This could include specialized permits for providing transportation services or tour guiding in certain regions.
Compliance: You must comply with all local regulations governing your service provision. This includes following road safety laws, vehicle regulations, insurance requirements, and other regulations that govern personal assistant or transportation services.
3. Vehicle Ownership and Condition
If you are offering transportation services, you warrant and confirm the following:
Ownership or Legal Right to Use: You either own or have the legal right to operate the vehicle you use for transportation services. This means you are the registered owner or have obtained permission from the vehicle’s owner to use it for providing services through the Tripattendynt platform.
Vehicle Condition: The vehicle you use must be in good operating condition, free from mechanical faults or safety hazards. The vehicle should pass any mandatory inspections and meet the local and state safety standards. This includes ensuring that the vehicle is regularly maintained and has no mechanical issues that could compromise the safety of passengers.
Safety Compliance: Your vehicle must meet Tripattendynt’s vehicle guidelines, which may include specific features, such as seat belts for all passengers, properly functioning airbags, and other safety measures. You must ensure the vehicle’s condition aligns with industry safety standards.
Safety Recalls: If your vehicle is subject to any safety recalls, you must address these recalls according to the manufacturer’s instructions before using the vehicle for any transportation service. This ensures that travelers are not at risk due to unresolved vehicle issues.
Insurance Requirement
You are required to maintain active and valid insurance coverage that complies with all local and state laws. This coverage should meet or exceed the minimum insurance requirements for vehicles used in commercial operations.
Tripattendynt assumes that your vehicle is always insured while you provide transportation services. However, you are responsible for ensuring that your insurance is up-to-date and appropriate for the services you are providing.
Proof of Insurance: You must provide proof of your insurance coverage to Tripattendynt upon request. This may include providing your policy number, insurer’s name, and coverage limits.
Liability: Tripattendynt is not liable for any accidents, damages, or incidents involving your vehicle. You assume full responsibility for any liability arising from your use of the vehicle in service provision.
4. Safe Behavior and Conduct
As an attendant, you agree to:
Operate Your Vehicle Safely: You must always follow local traffic laws and drive with care and attention to ensure the safety of passengers and others on the road.
No Driving Under the Influence: You must not drive under the influence of alcohol, drugs, or any other substance that impairs your ability to safely operate a vehicle.
No Unauthorized Passengers: You are prohibited from carrying unauthorized passengers while providing services through the platform. Only the travelers you are booked to assist should be present in your vehicle during trips.
Reckless Driving or Unsafe Conduct: You must avoid any form of reckless driving or unsafe behavior. This includes speeding, distracted driving, aggressive driving, or failing to maintain vehicle safety. You should not engage in any behavior that could endanger the traveler’s safety.
Accident Reporting: In the event of an accident or incident, you must immediately report it to Tripattendynt and provide the necessary details. You must also follow any required legal procedures for accident reporting as per local laws.
5. Attendant Service Fee
Attendants are compensated based on the services they complete. You will receive a 72% service fee of the total fee for each trip you successfully complete.
Trip Details: Upon being booked, you will be able to see the exact amount you will earn from completing the scheduled trip in the trip details section. This will include a breakdown of the total service fee and your earnings.
Service Completion: You will receive the agreed compensation after successfully completing the scheduled service. If the service is not completed due to your fault, you will not be compensated.
Payment: Payments will be processed through the Tripattendynt platform and will follow the payment cycle outlined by Tripattendynt. Payments will reflect your earnings based on completed services.
6. Non-Transportation and Non-Tour Operator Role
Tripattendynt is not a transportation or tour service provider. As an attendant:
- You are an independent service provider offering personal assistant or tour guide services.
- You are fully responsible for your own decisions regarding providing services.
- Travelers have sole discretion to accept or decline your services.
- Tripattendynt does not oversee your services beyond providing the platform for connections.
7. Service Delivery
By using Tripattendynt, you agree to:
- Provide high-quality and professional services.
- Respond promptly to traveler inquiries.
- Adhere to Tripattendynt’s quality and safety standards.
- Not misrepresent your services or abilities.
Tripattendynt provides the platform “as is” and does not guarantee:
- Any specific number of bookings or earnings.
- The availability of travelers on the platform.
Tripattendynt may limit access to the platform in certain regions or at certain times.
8. Personal Information and Conduct
- You agree to interact professionally with travelers and other users.
- You are responsible for the accuracy of your profile and communications.
- Tripattendynt is not liable for disputes between attendants and travelers.
9. Fraud and Misrepresentation
You agree not to engage in fraud, misrepresentation, or deceptive practices.
- If fraud is suspected, Tripattendynt may suspend or terminate your account.
- Any earnings linked to fraudulent activity may be withheld.
10. Non-Discrimination and Accessibility
You must not discriminate against travelers based on:
- Race, nationality, gender, religion, disability, or any other protected characteristic.
- You must accommodate travelers with disabilities, including those with service animals or mobility devices, in accordance with Tripattendynt’s policies.
11. Non-Circumvention Policy
To protect the platform, attendants must not:
- Solicit or accept off-platform payments or direct bookings from travelers.
- Share personal contact details to bypass the platform.
Consequences for Violations
Any violation may result in:
- Immediate account termination.
- Forfeiture of unpaid earnings.
- Legal action, including financial damages.
12. Insurance and Liability
- Tripattendynt is not responsible for personal belongings left behind by travelers.
- You assume full responsibility for your vehicle, accidents, and liability.
- Tripattendynt is not liable for losses, injuries, or claims arising from your services.
- You agree to indemnify Tripattendynt against any legal claims resulting from your actions.
13. Background Checks and Compliance
- Tripattendynt may conduct background and driving history checks.
- You consent to the collection of your personal information for safety and verification purposes.
14. Tax Responsibilities
- You are an independent contractor and responsible for all applicable taxes.
- Tripattendynt does not withhold taxes on your behalf.
15. Cooperation with Investigations
- If requested, you agree to cooperate with Tripattendynt’s investigations into any complaints, disputes, or legal inquiries.
- You must provide truthful and accurate information when requested.
16. Force Majeure
Tripattendynt will not be held responsible for any delay or failure in the performance of its obligations caused by circumstances beyond its reasonable control, including but not limited to:
- Natural disasters, labor disputes, governmental regulations, pandemics, internet disruptions or other uncontrollable events.
17. Termination of Service
Tripattendynt reserves the right to:
- Suspend or terminate your account for policy violations.
- Withhold earnings during an investigation of misconduct.
- Remove attendants with low ratings or poor service performance.
18. Limitation of Liability
- Limitation of Damages: To the fullest extent permitted by law, Tripattendynt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the platform or services.
- Any transaction conducted through or facilitated by the platform.
- Any other matter relating to the platform, regardless of whether Tripattendynt has been informed of the possibility of such damages.
- Total Liability: In no event shall Tripattendynt’s total liability exceed the amount you have paid, if any, to Tripattendynt for the services rendered during the 12 months immediately preceding the event giving rise to the liability.
19. Indemnification
- You agree to indemnify, defend, and hold harmless Tripattendynt, its affiliates, employees, agents, directors, and representatives from any claims, actions, demands, liabilities, damages, and expenses (including legal fees) arising out of:
- Your breach of these terms and conditions.
- Your use of the Tripattendynt platform and services.
- Any claims made by third parties related to your actions, services, or negligence.
- This indemnification will apply to the extent permitted by law and will survive termination of your agreement with Tripattendynt.
20. Dispute Resolution and Jurisdiction
- Arbitration: Any dispute, controversy, or claim arising out of or in connection with these terms shall be resolved through binding arbitration. The arbitration shall be conducted under the rules of a mutually agreed-upon arbitration body, and the venue shall be determined by Tripattendynt. The arbitration shall be conducted in English, and the arbitrator’s decision will be final and binding on both parties.
- Class Action Waiver: You agree that you will not participate in any class action, class arbitration, or any other proceeding where a third party is acting in a representative capacity, either in court or in arbitration, in relation to any dispute or claim arising out of or in connection with these terms.
- Governing Law: These terms and conditions will be governed by and construed in accordance with the laws of the jurisdiction in which Tripattendynt is incorporated, without regard to its conflict of law principles.
- Jurisdiction: The courts located in the jurisdiction in which Tripattendynt is incorporated shall have exclusive jurisdiction over any disputes, and you agree to submit to the personal jurisdiction of those courts.
21. Severability
- If any provision of these terms is found to be invalid, illegal, or unenforceable by a court or competent authority, such provision will be modified to the extent necessary to make it enforceable while maintaining the original intent of the provision. The remaining provisions will continue to be valid and enforceable.
22. No Waiver
- Waiver of Rights: The failure of Tripattendynt to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these terms will be effective only if in writing and signed by an authorized representative of Tripattendynt.
23. No Employment Relationship
- Independent Contractor: You acknowledge that by using the Tripattendynt platform, you are an independent contractor and not an employee of Tripattendynt. As such, you are not entitled to any benefits, insurance, or compensation provided to employees of Tripattendynt. You are responsible for your own expenses, taxes, and insurance related to providing your services.
24. Data Protection and Privacy
- Data Collection: Tripattendynt collects personal information from attendants and travelers in accordance with applicable laws and regulations. By agreeing to these terms, you consent to the collection, use, and processing of your personal data by Tripattendynt in accordance with its Privacy Policy.
- GDPR Compliance: If you are located in the European Union (EU) or the European Economic Area (EEA), you acknowledge and consent to Tripattendynt’s processing of your personal data in compliance with the General Data Protection Regulation (GDPR). This includes your rights to access, correct, or delete your personal data as well as your right to withdraw consent.
- Data Security: Tripattendynt takes reasonable precautions to protect your personal data from unauthorized access, use, or disclosure. However, by using the platform, you acknowledge that no method of data transmission or storage is 100% secure, and Tripattendynt cannot guarantee the security of your information.
25. Right to Modify the Platform
- Platform Modifications: Tripattendynt reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, including the availability of certain features, services, or content. Tripattendynt will make reasonable efforts to inform attendants of any significant changes to the platform but is not obligated to do so in all cases.
- No Liability: Tripattendynt shall not be held liable for any damages or losses resulting from modifications, suspension, or discontinuation of the platform or its services.
26. Communications and Notices
- Electronic Communications: By using the Tripattendynt platform, you consent to receive communications, including notices, updates, and other information, electronically from Tripattendynt. Tripattendynt may send these communications via email, in-app notifications, or posting on the platform.
- Notice to Attendants: You agree that any notices required or permitted by these terms can be sent electronically to the email address you have provided to Tripattendynt or through in-app notifications.
27. Third-Party Services
- The Tripattendynt platform may contain links to third-party websites or services that are not owned or controlled by Tripattendynt. Tripattendynt has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
- You agree that Tripattendynt will not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with your use of any third-party services.
28. Intellectual Property
- Ownership of Content: Tripattendynt retains all rights, titles, and interests in and to the platform, including all intellectual property rights related to the platform’s software, content, trademarks, and other materials. You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes as an attendant.
- Use of Trademarks: You agree not to use the Tripattendynt trademark, logo, or other proprietary information without prior written consent from Tripattendynt.
29. Entire Agreement
- These terms constitute the entire agreement between you and Tripattendynt regarding the use of the platform and services, superseding any prior agreements or understandings (whether written or oral) between you and Tripattendynt regarding the subject matter of these terms.
30. Changes to These Terms
Tripattendynt may update these Terms at any time, without prior notice.
- Changes will be effective immediately upon posting.
- It is your responsibility to review these Terms regularly.
Your continued use of the platform constitutes acceptance of the updated Terms.
If you do not agree to these Terms, you must stop using the platform immediately.
